Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Elselife (“the Service”), a prestige text-based life simulator operated by the Elselife app owner. By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Elselife lets you choose a year, city, and starting age, then generates a fictional life narrative using a large language model accessed through your own API key. The Service stores your game state and routes your prompts to the AI provider you select. We do not provide the underlying AI model; that relationship is between you and the provider whose key you supply.

3. Account registration and bring-your-own-key

You may sign in using Google OAuth or email authentication. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. To play, you must provide a valid API key from a supported provider. You are solely responsible for:

• The security of your API key.
• Compliance with your provider's terms and usage limits.
• All charges incurred through your key with that provider.
• Any content generated by the model using your key.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe intellectual-property or privacy rights of others.
• Generate, distribute, or solicit harmful, illegal, or abusive content.
• Attempt to gain unauthorized access to the Service or its infrastructure.
• Interfere with or disrupt the Service, servers, or networks.
• Use automated scripts or bots to access the Service in ways not authorized.
• Share another person's personal data without permission.

We may suspend or terminate your account for violations of these rules.

5. User content and generated content

You retain any rights you have to the prompts and choices you submit. You grant us a limited license to store, process, and transmit that content solely as necessary to operate the Service and deliver the game to you.

Narrative output is generated by third-party AI models and may be unpredictable, inaccurate, or inconsistent with historical facts. We do not guarantee the quality, accuracy, or appropriateness of any generated content. You use generated content at your own risk.

6. AI provider relationship

The Service acts as a routing layer between you and the AI provider you choose. We are not responsible for the availability, pricing, output, security practices, or terms of service of any third-party AI provider. Your use of an AI provider through the Service is subject to that provider's applicable terms and privacy policy.

7. Payments and refunds

Elselife does not currently charge for access to the Service. Any API usage costs are billed directly to you by the AI provider whose key you provide. We do not process those payments and offer no refunds for provider charges.

8. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or exposes us to legal liability. You may delete your account at any time through the Service or by contacting us.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements or that defects will be corrected.

10. Limitation of liability

To the fullest extent permitted by law, the Elselife app owner and its representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us to use the Service in the twelve months preceding the claim, or one hundred US dollars, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless the Elselife app owner and its representatives from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing law and disputes

These Terms shall be governed by the laws of [Jurisdiction — to be completed by the app owner], without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts or through the arbitration procedures located in that jurisdiction, unless otherwise required by mandatory local law.

13. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.
